IMPORTANT UPDATE ON ASSOCIATION FINES

EFFECTIVE JULY 25, 2025, THE TAHOE DONNER BOARD OF DIRECTORS PASSED A RESOLUTION TO ADOPT A TEMPORARY FINE SCHEDULE UNDER NEW STATE LAW, WHICH WILL REMAIN IN PLACE UNTIL MEASURES CAN BE TAKEN TO ADOPT A PERMANENT FINE SCHEDULE. Notice of Emergency Rule Change: Administrative Resolution 2025-20, Emergency Adoption of Updated Fines Schedule
Effective Date: November 25, 2025

Emergency Rule Change Expiration Date: March 25, 2026

The Board of Directors has adopted Administrative Resolution 2025-20, enacting an emergency rule change to temporarily amend the Association’s fines schedule in response to recent updates to state law and to address threats and risks to the health, safety, and welfare of the Association and its members. This emergency action ensures alignment with the Davis-Stirling Act and the Tahoe Donner governing documents, while a formal rule change process is initiated to consider permanent revisions.

Purpose of the Emergency Rule Change

The temporary amendment to the fines schedule serves the following purposes:

1. Protect the health, safety, and welfare of the Association and its members.
2. Allow for the immediate implementation of changes required by new state legislation.
3. Proactively address regulatory updates by ensuring consistency with current laws and governing documents.

Effect of the Emergency Rule Change

The immediate outcomes of this resolution include:

1. Modification of the Association’s fines schedule, effective November 25, 2025.
2. Continued ability to enforce violations of the Association’s governing documents, including those related to health and safety.

This emergency measure will remain in effect while the Board initiates a formal process to consider permanent rule and fine schedule updates, including potential adjustments to enforcement procedures.

The January 2026 Tahoe Donner News + Lifestyle will launch a 45-day member comment period for the Board’s consideration of permanently adopting the proposed fine schedule changes at the February 27, 2025 board meeting.
