Proposed Off-Road Vehicle Rule Change, Electric Bicycle Regulation and Other Noted Changes

July 1, 2021

Pursuant to Tahoe Donner Covenants and Restrictions Article III, Section 7, modifications to rules and proposed new rules must go out for 45-day member notification and comment period prior to Board of Director consideration and/or approval. Changes to the Tahoe Donner Association Off-Road Vehicle Rule will be considered for action by the Board of Directors. The Board of Directors is expected to take action to adopt the proposed amendments, as they are presented here or with some modification, at the August Board of Directors meeting, to be scheduled for August 27, 2021. The Board welcomes any input the membership may wish to offer regarding this process.

August 27, 2021 Update: Member Comment Period extended through September 13 and discussion for potential adoption will happen at an upcoming Board Meeting – date TBD.

Proposed Election + Voting Rules

Pursuant to Tahoe Donner Covenants and Restrictions Article III, Section 7, modifications to and proposed new rules must go out for 45-day member notification and comment period prior to board of director consideration and approval. Changes to the Tahoe Donner Association Election and Voting Rules will be considered for action by the Board of Directors. The Board of Directors is expected to take action to adopt the proposed new rules and amendments, as they are presented here or with some modification, at a special March board of directors meeting, to be scheduled for early March 2021. Fire Safety and Seasonal Fire Ban

Changes to the Covenants Private Property Rules: Fire Safety (Covenants Rules) sections, including section 4.19 Seasonal Fire Ban and 4.21 Fire Prevention and Safety, will be considered for action by the board of directors. The board of directors is expected to take action to adopt the proposed new rules and amendments, as they are presented here or with some modification, at its July board of directors meeting. Accessory Dwelling Units + Junior Accessory Dwelling Units

January 1, 2020

As you may know, California is facing a housing crisis, exemplified by the lack of sufficient affordable long-term housing units. The response from the State has been to adopt certain laws and regulations that supersede local zoning and land-use laws and require local jurisdictions to facilitate and encourage the construction and use of accessory dwelling units (ADU’s) and junior accessory dwelling units (JADU’s).

That state-wide effort has expanded to include homeowner’s associations. Effective January 1, 2020, Assembly Bill 670 will amend the Davis Stirling Act and render void and unenforceable any restriction in association governing documents that would effectively prohibit or unreasonably increase the cost of constructing or using an ADU or JADU. Tahoe Donner’s Covenants and Restrictions has a prohibition of accessory dwelling units. With the passing of AB670, that prohibition will no longer be in force starting January 1, 2020.

A covenants rule and fine are proposed to provide the board of directors the ability to act on a violation of the Truckee Fire Protection District Nevada County Ordinance 03-2019, a seasonal fire ban on outdoor woodburning fires, including charcoal grills.
